Examples
2026-27, no fringe benefits unless shown.
| Scenario | Division 293 tax |
|---|---|
| Under the threshold | $0 |
| Just over: partly taxed | $1,875 |
| Income at the threshold | $4,875 |
| Well over | $4,875 |
| Investment loss counts ($20,000 loss) | $1,875 |
| Carry-forward contribution ($27,500 carried forward) | $9,000 |
The second row shows the lesser-of rule: only $12,500 of the $32,500 is taxed, because that is all that sits above $250,000. The third row shows that income at the threshold is enough: adding contributions takes you over.
How we calculate
- Division 293 income uses the Medicare levy surcharge income test but ignores reportable super contributions: taxable income + reportable fringe benefits + net financial investment loss + net rental property loss.
- Add your concessional contributions. Only excess contributions (above your cap, including any carried-forward amounts) are disregarded. Contributions covered by carried-forward cap are not excess and do count.
- If the total is over $250,000, tax = 15% x the lesser of your counted contributions and the amount over.
- The ATO works out your Division 293 income, contributions and any excess after year end, so your actual assessment may differ.
Questions
Can I pay Division 293 tax if my income is under $250,000?
Yes, it is possible. The test is Division 293 income plus concessional contributions. Taxable income of $230,000 with $32,500 of contributions is $12,500 over, so $1,875 is payable.
Is it charged on all my contributions?
Only on the lesser of your contributions and the amount by which income plus contributions exceeds $250,000.
Do carry-forward contributions count?
Yes. Contributions covered by unused cap from earlier years are not excess, so they count for Division 293 (check your carry-forward room). Only excess contributions are left out.
Do investment losses reduce my Division 293 income?
No, they are added back. Net financial investment losses and net rental property losses increase Division 293 income, as they do for the Medicare levy surcharge test.
